Contracts Register

Under Section 27 of the Government Information (Public Access) Act 2009 (GIPA), we must maintain a register detailing information about government contracts valued at $150,000 or more, which include:

  • A contractor undertaking a specific project
  • A contractor agreeing to supply specific goods or services
  • Transfer of real property, or
  • Rent payments under a lease.

Employment contracts are exempt from this requirement.

The Act categorises contracts into three classes, each with specific disclosure criteria:

Class 1: Contracts valued at $150,000 or more.

Class 2: Contracts also valued at $150,000 or more, and additionally:

  • No public tender occurred and terms were negotiated directly
  • Tender occurred but terms were substantially negotiated after
  • One or more parties must maintain or operate infrastructure for 10+ years
  • Privately financed projects (defined by Treasury)
  • Significant asset transfers or exchanges.

Class 3: Class 2 contracts valued at $5 million or more.
